This Privacy Policy describes how we collect, use and disclose personal information in connection with the Service, and the choices and rights available to you. It is effective as of the date above.
In this Privacy Policy, "personal information" means information about an identified or identifiable individual, and "including" means "including without limitation". This Privacy Policy is not a contract and does not form part of our Terms of Service. Where the law requires your consent to a particular use of your personal information, we request it separately.

- How we use it. To provide, secure and improve the Service, apply our age rules and usage limits, communicate with you and comply with the law.
- Who can see it. Other users can see your username and profile photo. No other user can see your trips unless you share them with your friends, and friends who can see your content can save or copy it.
- Who receives it. Our service providers and the other recipients described in Section 5. We do not sell your personal information.
- Your choices. You can download your data or delete your account in the App, and exercise the rights described in Sections 9 and 12.

The President of Planespotting Inc. is our Privacy Officer, is responsible for this Privacy Policy and our privacy practices, and is accountable for the personal information we hold. Access to personal information is limited to personnel who require it to perform their duties. Section 8 describes how long we retain personal information, and Section 9 describes how we handle requests and complaints.
3. Information we collect
We collect personal information that you provide to us, that we obtain from your device with your permission, that we collect automatically when you use the Service, and that we receive from others.
Information you provide.
- Account information. Your name, email address, username and profile photo, and your settings in the App.

We retain your place of residence, your birth month and year if you provide them (except for accounts in Australia), whether you met the minimum age and whether you were 18 or older. We do not retain the age range shared by Apple.
- Content. The trips, photos, captions and spots you add to the Service, the flights you log, your suggestions for the catalog, and other information you save in the App, such as your favourite airports. The details of a flight you log, and the weather, runway and airport information recorded with a trip, come from third-party data providers.
- Friends and blocks. Your friends, the friend requests you send and receive, and the users you block.
- Communications. The reports you submit, the problems you report, and the messages you send us.
- Records of your choices. The versions of our Terms of Service and this Privacy Policy that you accepted, the notices you acknowledged in the App, and your choices about promotional emails, each with its date.
Information from your device.
- Location information. With your permission, the App uses your device's precise location to provide the location features of the Service, and we collect it when you choose to save it, such as for a spot's pin. Your trips and spots also record the locations you select.
- Camera and photo library. With your permission, the App accesses your device's camera and photo library so that you can add photos, and may save the photos you take with the App's camera to your photo library. The App also stores copies of your photos on your device.
Information we collect automatically.
- Usage information. Information about how you use the Service, such as the information your account requests and when, and records of your account's use against our usage limits.
- Device and technical information. Your device type, operating system and app version; identifiers for your device and your installation of the App, including notification tokens; IP addresses; and sign-in, security, server and crash records.
Information we receive from others.
- Apple and Google. If you sign in with Apple or Google, your name, email address (or an Apple relay address) and account identifier. Apple also provides the age information described in this Section and may notify us of changes to your Apple Account, such as a parent's withdrawal of consent.
- Purchases. If you purchase Planespotting Pro, Apple processes the payment, and we do not receive your payment card details. We receive your subscription status and purchase records through our subscription provider.
- Other users. Other users can send you a friend request, accept yours or block you, report you or your content, or add content that depicts or mentions you. We do not tell you who reported you, except as our Terms of Service allow or the law requires.
Required information. To create an account, you must provide an email address and your name (or sign in with Apple or Google), a username, your place of residence and your age information. We cannot create an account without this information. All other information is optional, although some features require it. No law requires you to provide personal information to us.
4. How we use information
We use personal information:
- To provide the Service, including your account, your content, Planespotting Pro and support.
- To display the content you share to the users you share it with, and catalog spots to users of the Service.
- To apply the minimum age, the protections for people under 18 described in Section 10, and the settings that depend on your age or place of residence.
- To maintain the safety and security of the Service, including to check content, review reports, apply usage limits, detect and prevent fraud and abuse, and enforce our Terms of Service.
- To communicate with you, as described under "Messages from us" in this Section.
- To measure and analyze how the Service is used, and to plan its operation.
- To improve the Service and develop new features and services.
- To create de-identified, anonymized and aggregated information, as described in Section 6.
- To comply with the law, respond to lawful requests, protect the rights, property and safety of Planespotting, our users and others, and establish, exercise or defend legal claims.
- For other purposes that we describe to you when we collect the information, or to which you consent.
We do not currently collect, use or sell personal information to train large language models. We do not use your content to promote the Service, or provide it to another company for that company's own use, including to train its own models, without your consent, except as described in Section 5. We do not use photos to identify individuals by their facial features.
Messages from us. We may send you messages about your account, your purchases, your trips, your friends, your reports and suggestions, and changes to our Terms of Service or this Privacy Policy. These messages form part of the Service. Where you have agreed or the law otherwise permits, we may also send you promotional emails. Each promotional email includes a means to unsubscribe, and unsubscribing does not affect messages about your account.
5. Who can see and receive information
Other users.
- Users of the Service can see your username and profile photo and can find you by your username.
- No other user can see your trips unless you share them with your friends. Your friends can see the trips you share, including their locations, times, photos, flights and captions, and other information on your profile, such as your Collection and whether you have Planespotting Pro.
- If you suggest one of your spots for the catalog, we may use it, including its photos, to create a catalog spot that is visible to users of the Service and does not name you. If you were 18 or older when you suggested it, we may also license the catalog spot's name, location and details to others, without its photos or any information that identifies you.
- Users who can see your content can copy, save or share it outside the Service. We are not responsible for what other users or third parties do with content you share, and deleting your content does not remove copies that others have made.
Our personnel. Our personnel may access your content, including content you have not shared, where necessary to provide and support the Service, review reports, flagged content and catalog suggestions, respond to your requests, resolve problems, investigate abuse or security incidents, or comply with legal obligations.
Service providers. We disclose personal information to service providers that perform services for us, such as hosting and storage, automated content moderation, crash reporting, subscription management, email delivery and hosting, app updates and notifications, and website hosting. Our service providers may use personal information only to provide services to us, and must provide the same or equal protection of personal information as this Privacy Policy. When you use Sign in with Apple, Google Sign-In, Apple Maps or the App Store, Apple and Google receive information under their own terms and privacy policies, as described in Section 13.
Professional advisers. Our lawyers, accountants, auditors and insurers, where they require it to provide services to us.
Legal, safety and enforcement. We may access, preserve and disclose personal information where the law requires or permits it, including where we believe in good faith that doing so is necessary to comply with the law or legal process, respond to a lawful request from a public authority, enforce our Terms of Service, detect, prevent or address fraud, abuse, security or technical problems, protect the rights, property or safety of Planespotting, our users or the public, or establish, exercise or defend legal claims. We report child sexual abuse and exploitation material to the authorities and organizations the law designates.
Business transactions. If we are involved in an actual or proposed merger, acquisition, financing, reorganization, sale of assets, bankruptcy or similar transaction, personal information may be disclosed to the other parties and their advisers and transferred as part of the transaction. A recipient may use it only for the purposes described in this Privacy Policy unless you consent otherwise.
With your consent. Other recipients, where you direct us to share information or consent to it.
No sale, no tracking. We do not sell your personal information or share it for targeted advertising. We do not permit other companies to track you across other companies' apps or websites through the Service, and the Service does not respond to Do Not Track signals. Our website does not use cookies for advertising or tracking.
6. De-identified, anonymized and aggregated information
Subject to Section 10, we may de-identify personal information to produce statistics, conduct research and improve the Service. De-identified information remains personal information under this Privacy Policy, and we disclose it only to our service providers or as described under "Legal, safety and enforcement" and "Business transactions" in Section 5.
We may also anonymize or aggregate personal information so that it no longer identifies any individual and cannot reasonably be linked to an individual or a device. Anonymized and aggregated information is not personal information. We may use, publish, share and license it for any lawful purpose, including commercial purposes, and retain it without time limit.
Limits. We do not attempt to re-identify de-identified or anonymized information, except to test our methods. We require by contract that any company to which we disclose anonymized information not re-identify it. Anonymized information that we share or license never includes content you create, location information about an individual, or information from the accounts of people under 18.
7. Where information is stored
Our primary database and file storage are located in Canada. Our service providers may process personal information in the United States and other countries, and personal information may therefore be communicated outside Québec and outside Canada. Personal information held in another country is subject to that country's laws and may be accessible to its courts, law enforcement and national security authorities. The friends with whom you share content might live in countries whose laws protect it less than the laws where you live.
8. How long we keep information
We retain personal information for as long as necessary for the purposes described in this Privacy Policy, and longer where the law requires or permits, such as to meet legal, tax and accounting obligations, resolve disputes, enforce our agreements, or establish, exercise or defend legal claims. Our general retention practices are as follows:
- Account information and content: until you delete them or your account.
- Reports, moderation records and content held for review: for as long as necessary to handle the report, enforce our Terms of Service and comply with legal obligations, including after your account is deleted.
- Support requests and problem reports: for as long as necessary to respond to you and keep a record of the request.
- Purchase records: for as long as necessary for receipts, refunds and disputes, and as tax and accounting laws require.
- Service and security records, including usage information: for as long as necessary to operate, secure and measure the Service and apply our usage limits.
When we no longer need personal information, we delete or anonymize it. Information in backups is kept secure and isolated from further use until it is deleted in the ordinary course.
Account deletion. You can delete your account in the App's account settings. Deletion begins when you confirm it. We then delete your account information and content, except that we may retain, for the periods described in this Section, reports, moderation records and content held for review; the information needed to prevent a person whose account we terminated from opening another account; catalog contributions, without your name; support requests and problem reports; purchase records; records of your choices; service and security records; and anonymized and aggregated information. Some of these records may continue to identify you. Deletion does not affect copies saved to your device's photo library. Deleting your account does not cancel a subscription; you must cancel it in your Apple Account's subscription settings.
9. Your choices and rights
Choices. In the App, you can edit or delete your content, choose who can see each trip, turn catalog suggestions and promotional emails on or off, download a copy of your account information and content, and delete your account. You can manage location, camera, photo library and notification permissions in your device settings. To correct your email address, name or age information, or to obtain a copy of other personal information, contact us.
Your rights. Depending on where you live, you may also have a legal right to access the personal information we hold about you, obtain a copy of it, including in a portable format, correct it, delete it and withdraw your consent to its use. These rights are subject to the limits and exceptions in applicable law, and if you withdraw your consent, some features may no longer be available. Section 12 describes additional rights in specific regions.
Making a request. To make a request, email support@planespottingapp.com. We may need to verify your identity before acting on a request, and may require proof that a person acting on your behalf is authorized. We do not charge a fee, unless the law permits one and we inform you of it in advance. We respond within the time the law requires. We may refuse a request where the law allows, and if we do, we inform you of the reasons where the law requires and of how to complain.
Complaints. Complaints should first be directed to our Privacy Officer. We respond in writing within the time the law requires. If you are not satisfied with our response, you may contact the privacy regulator where you live, as described in Section 12.
10. Children and teens
The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. The minimum age to use the Service depends on where you live and is set out in our Terms of Service. We determine the minimum age that applies to you from your place of residence, the country of your Apple Account and the information Apple provides about your Apple Account. If we learn that a person under the applicable minimum age has an account, we close the account and delete its information, except as the law requires or permits us to retain it. A parent or guardian may contact us at support@planespottingapp.com.
For the accounts of people we know are under 18, we use personal information only to provide, maintain, secure and repair the Service, for our internal operations, to apply our age rules and to comply with legal obligations. We do not sell it, or use it for advertising, marketing or research and development, including training models.
If you are under 18, you may remove content you have added to the Service, in the App or by contacting us. Removal does not delete copies that others have made, and catalog contributions remain in the catalog without your name.
11. Security
We use administrative, technical and physical safeguards designed to protect personal information, appropriate to its sensitivity. No method of transmission over the internet or of electronic storage is completely secure, and we cannot guarantee the security of personal information. You are responsible for protecting your device and your sign-in methods. To the extent permitted by law, you provide personal information at your own risk, and we are not responsible for the circumvention of any privacy settings or security measures of the Service by others. Where the law requires, we notify you and the relevant authorities of a breach of security involving your personal information.
